Terms of Service

1. Acceptance of Terms

By accessing or using the Claryn platform (“Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms. If you do not agree, do not use the Service.

2. Description of Service

Claryn provides a cloud-based platform for building, deploying, and managing autonomous voice AI agents. The Service includes a visual agent builder, call management, CRM integrations, outbound campaign tools, analytics, and related features. We reserve the right to modify or discontinue any feature with reasonable notice.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@tryclaryn.live if you suspect unauthorised access.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations, including telemarketing, consent, and calling laws in your jurisdiction
  • Make calls without obtaining the required consents from call recipients
  • Transmit harmful, fraudulent, deceptive, or abusive content
  • Impersonate any person or organisation without authorisation
  • Interfere with or disrupt the Service, its infrastructure, or other customers
  • Attempt to gain unauthorised access to any part of the Service or third-party systems
  • Resell or sublicense access to the Service without written permission
  • Use the Service to generate or distribute spam

We reserve the right to suspend or terminate accounts that violate these provisions without refund.

5. Voice Credits & Billing

Paid plans are billed monthly on your subscription date. One voice credit equals approximately one minute of AI agent call time. Credits reset each billing cycle and do not roll over.

You authorise us to charge your payment method on file for all fees. All fees are non-refundable except as described in our Refund Policy. We will provide at least 14 days notice of any price changes.

6. Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We offer a 14-day money-back guarantee on your first payment for any paid plan. Subsequent charges are non-refundable except in cases of billing errors. See our Pricing page for full details.

7. Intellectual Property

The Service, including its software, design, and documentation, is owned by Claryn and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your business purposes.

You retain full ownership of your data, agent configurations, and call recordings. You grant Claryn a limited licence to process this data solely to provide the Service.

8. Data & Privacy

Our handling of your data is governed by our Privacy Policy, which is incorporated into these Terms. By using the Service, you consent to the data practices described therein.

9. Compliance with Calling Laws

You are solely responsible for ensuring your use of the Service complies with all applicable calling, telemarketing, and consumer protection laws, including but not limited to TCPA (US), PECR (UK), and equivalent regulations in your jurisdiction. Claryn is a platform provider and does not provide legal advice.

10. Service Availability & SLA

We target 99.9% uptime for core platform features. Scheduled maintenance windows will be communicated with at least 24 hours notice. We are not liable for downtime caused by third-party providers (Twilio, Telnyx, cloud infrastructure) or circumstances beyond our reasonable control.

11. Limitation of Liability

To the maximum extent permitted by law, Claryn shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, or business interruption — arising from your use of the Service. Our total liability for any claim shall not exceed the fees you paid to us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Claryn harmless from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights or applicable laws.

13. Termination

We may suspend or terminate your account immediately for violation of these Terms, non-payment, or if we reasonably believe your use poses a legal or security risk. You may terminate your account at any time from your dashboard. Upon termination, your data will be retained for 90 days before deletion.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
